Mule Barbell Terms of Service

These Terms of Service govern your use of the Mule Barbell website and any purchases made through mulebarbell.com.

By visiting our site or purchasing from us, you agree to these Terms.

1. About Mule Barbell

Mule Barbell is an Ontario-based business selling original apparel and related products.

All artwork, graphics, logos, written content, branding, product designs, and other creative materials displayed on this website are owned by Mule Barbell unless otherwise stated.

2. Online Store Terms

You may not use our products, website, artwork, or services for any unlawful or unauthorized purpose.

You may not copy, reproduce, distribute, modify, trace, digitize, resell, license, or commercially exploit any artwork, design, graphic, logo, photograph, written content, or other material from this website without prior written permission.

Purchasing a Mule Barbell product does not transfer any copyright, intellectual property rights, reproduction rights, or commercial-use rights to the purchaser.

3. Products and Availability

We make every effort to display our products as accurately as possible.

Colours, placement, sizing, and appearance may vary slightly due to differences in monitors, devices, garment manufacturing, print production, or normal production tolerances.

Many Mule Barbell products are produced on demand after an order is placed.

Product availability may change without notice. We reserve the right to discontinue, limit, or modify products at any time.

4. Pricing

All prices are displayed in the currency shown on the website.

Prices, promotions, discounts, shipping charges, and product availability may change without notice.

If a product is listed at an incorrect price due to an error, we reserve the right to cancel or correct the affected order. If payment has already been processed, the customer will be refunded where applicable.

5. Orders

Submitting an order does not guarantee acceptance.

We reserve the right to refuse, cancel, or limit an order where reasonably necessary, including in cases involving:

• suspected fraud;

• pricing or listing errors;

• payment issues;

• product availability;

• suspected resale or commercial misuse;

• abuse of our exchange or refund policies.

If we cancel an order after payment has been processed, the applicable amount will be refunded.

Customers are responsible for providing accurate billing, shipping, and contact information.

We are not responsible for delays or delivery problems caused by incorrect information provided at checkout.

6. Payment

Payment is processed through third-party payment providers made available through Shopify.

By submitting payment information, you represent that you are authorized to use the selected payment method.

We do not directly store full payment-card information.

7. Taxes

Applicable sales taxes are calculated and collected at checkout where required by law.

Customers outside Canada may also be responsible for local taxes, duties, customs charges, brokerage fees, or other import-related costs where applicable.

8. Shipping and Fulfilment

Mule Barbell products may be produced and fulfilled by third-party manufacturing and fulfilment partners.

Estimated production and shipping times are provided as guidelines only and are not guaranteed delivery dates.

Shipping delays caused by carriers, customs processing, weather, labour disruptions, incorrect addresses, or other circumstances outside our reasonable control are not considered a breach of these Terms.

Tracking information will be provided where available.

9. Exchanges and Refunds

Our Exchanges & Refunds Policy forms part of these Terms.

Because many products are produced on demand and our fulfilment partners do not generally accept returned merchandise, approved exchanges or refunds may not require the original item to be physically returned.

We reserve the right to request photographs or other information when reviewing claims involving damage, defects, misprints, incorrect items, or other product concerns.

We also reserve the right to limit or decline requests that appear fraudulent, excessive, repeated, or abusive.

10. Sizing

Customers are responsible for reviewing the applicable size chart before ordering.

Garment measurements may vary slightly due to normal manufacturing tolerances.

Ordering an incorrect size does not constitute a manufacturing defect, although eligible size-exchange requests may be accommodated in accordance with our Exchanges & Refunds Policy.

11. Intellectual Property

All original artwork and design work appearing on Mule Barbell products and on mulebarbell.com is protected by applicable copyright and intellectual-property laws.

Unless expressly authorized in writing, you may not:

• reproduce or copy our designs;

• trace or redraw our artwork;

• use our artwork in another product;

• upload our artwork to a print-on-demand platform;

• sell physical or digital reproductions;

• use our artwork for commercial purposes;

• remove or alter copyright, trademark, or ownership notices;

• create derivative commercial works based substantially on our designs.

Purchase of a physical product grants you ownership of that physical item only.

It does not grant any licence to reproduce, distribute, modify, sell, sublicense, or commercially exploit the artwork appearing on that product.

12. Website Content

We make reasonable efforts to keep information on this website accurate and current.

However, we do not guarantee that all descriptions, prices, product images, availability information, shipping estimates, or other website content will always be complete, current, or error-free.

We may correct errors and update information at any time without prior notice.

13. Third-Party Services

Our store is hosted by Shopify and may rely on third-party providers for payment processing, production, fulfilment, shipping, analytics, email marketing, advertising, and other services.

Your use of those services may also be subject to the terms and privacy practices of the applicable third-party providers.

Mule Barbell is not responsible for third-party websites, services, outages, or content outside our reasonable control.

• attempt unauthorized access to the website or related systems;

• interfere with website operation;
